In insolvency law, we advise exclusively on insolvency avoidance law and directors’ liability. In particular, we conduct litigation for our clients in these areas – predominantly for insolvency administrators.

What v. Einem & Partner can offer in the case of company insolvency:

In insolvency law, we mainly advise medium-sized companies. Our help is sought when companies get into economic difficulties and become insolvent, for example, due to market changes, bad investments, or inadequate management.

In the run-up to insolvency, the focus of our advice is on the development of strategies for avoiding insolvency and questions regarding the obligation to file for insolvency. If a company insolvency cannot be avoided, it must be filed for in good time – otherwise there is the threat of an insolvency delay with legal consequences.

Once insolvency proceedings are under way, we advise the insolvent entrepreneur or shareholder on how to exercise his/her rights vis-à-vis the insolvency administrator.

What v. Einem & Partner can offer to creditors:

Our law firm also supports creditors during ongoing or impending insolvency proceedings in enforcing their claims. This includes, among other things, the filing of claims in the insolvency table and the enforcement of separation or segregation for the client.
